Tip 2 – Don’t Be Discouraged If The Police Report Doesn’t Blame the Driver

It’s important to remember that a police report typically isn’t admissible as evidence at a personal injury trial. Therefore, even if the police report blames you for the incident, don’t let that deter you or your loved ones from pursuing your injury claim. I’ve personally handled several cases where the police report found my client at fault for the accident, and we were still able to secure a settlement.  In Kentucky, if you can prove that the driver was at least partially at fault for the accident, you are entitled to at least a partial recovery against the other driver.  

Tip 3 – Send a Policy Limits Demand in Writing

Sending a demand in writing for the policy limits can put pressure on the insurance company, as they have a duty to act in good faith when handling injury claims. If your claim is clearly worth the policy limits, they have a responsibility to offer the policy limits to you. Failing to do so in a timely manner can lead to a separate bad faith lawsuit against the insurance company.
