Some very tragic news was reported by WLKY. A motorcyclist died in a motorcycle crash on Sunday, October 9, 2022, around 7:30 p.m. Louisville Metro Police are investigating the wreck that occurred at the intersection of New Cut Road and Outer Loop. The driver of a vehicle was traveling north on New Cut Road and was making a left turn when the driver of the vehicle struck the motorcyclist who was headed west on Outer Loop. The motorcyclist died at the scene of the collision. The driver of the vehicle was transported to the University of Louisville hospital with non-life-threatening injuries.
Motorcycle accidents often, unfortunately, end tragically. Motorcyclists are more exposed, less visible, and unstable compared to all other vehicles on the roadway. As a result, motorcyclists experience higher fatality and injury rates than occupants of other vehicles who have safety protections of the vehicle’s metal frame, seatbelts, and airbags.
It can be extremely difficult to cope with the loss of a loved one. If you have a loved one who died in a motorcycle accident due to the fault of another driver, you may have a viable wrongful death claim that can help your family during a very difficult time. In a wrongful death lawsuit, the deceased person’s estate and/or family members can be compensated for the loss of their loved one. Damages can include lost earnings of the deceased, burial and funeral expenses, loss of care and support (and parental leadership), and damages that incur before death, such as pain and suffering and medical expenses.
In Kentucky, surviving family members can file a wrongful death lawsuit within one year from the date of death. Lawsuits filed after the one year do not have much of a chance of resulting in a financial recovery. Due to the limited time period, surviving family members have to file a wrongful death lawsuit, it is highly recommended the surviving family members consult with a wrongful death lawyer as soon as possible.
